Terms of Service

1. The service

fanfir.st lets independent musicians build release pages and "unlock" gates where fans trade an email (and optionally a phone number) to receive a free download, secret link, pre-save, or code — building a fan list the Artist owns and can export.

2. Accounts

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be at least 16 (or the age of majority where you live) to use fanfir.st.

3. Plans, billing & cancellation

• The core service is free. Pro is a paid subscription (monthly or annual).
• Subscriptions are billed through Creem and renew automatically until cancelled.
• You can cancel anytime; access continues until the end of the paid period.
• Except where required by law, payments are non-refundable. Prices may change with notice.
• Your fan-list export is never gated behind a paid plan.

4. Your content and your fans (Artist responsibilities)

You own the content you upload and are solely responsible for it. You represent that you have the rights to it and that it doesn't infringe others' rights or break the law. You grant us a limited license to host, store, and display it to operate the service.

When you collect fans through fanfir.st, you are the data controller for that fan data and fanfir.st is your processor. You are responsible for having a lawful basis to contact those fans, honoring unsubscribe requests, and complying with all applicable privacy and anti-spam laws (e.g. GDPR, PECR, CAN-SPAM). You must not import or collect contacts without a proper legal basis.

5. Acceptable use

Don't use fanfir.st to distribute illegal, infringing, deceptive, or harmful content; to send spam; to violate anyone's rights; or to abuse, scrape, overload, or reverse- engineer the service. We may suspend or remove content or accounts that break these Terms.

6. Intellectual property

The fanfir.st platform, brand, and software are ours. These Terms don't transfer any of our IP to you beyond the right to use the service.

7. Third-party services

fanfir.st integrates with third parties (e.g. Spotify, Creem, Google, PostHog). Your use of those is subject to their terms, and we're not responsible for them.

8. Disclaimers & limitation of liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.

9. Indemnification

You agree to indemnify us against claims arising from your content, your use of the service, or your handling of fan data in breach of these Terms or the law.

10. Termination

You can stop using fanfir.st and delete your account anytime. We may suspend or terminate accounts that violate these Terms. You can export your fan list before leaving.

11. Changes & governing law

We may update these Terms and will revise the date above; continued use means you accept the changes. These Terms are governed by the laws of Latvia, without regard to conflict-of-laws rules.
